Introduction

This Privacy Policy ("Policy") explains how Z2 Cool, LLC, Z2, Inc., and our subsidiaries and affiliates (collectively, "Z2," "we" or "us") collect, use and share information about you (“personal information”) when you access or use our website (the “Website”), access our other online services, attend our events, or otherwise interact with us (collectively, the "Services"). We may supply different or additional notices of our information practices specific to certain programs or activities, in which case this Policy will not apply.

You acknowledge that this Policy is part of our Terms of Use (defined below), and by accessing or using the Website, or otherwise utilizing our Services, you agree to be bound by all its terms and conditions. If you do not agree to these terms, please do not access or use this Website or our Services.

We reserve the right to change this Policy at any time. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to issuing an e-mail to the e-mail address listed by registered users and posting the revised Policy on this page. You acknowledge and agree that it is your responsibility to maintain a valid e-mail address as a registered user, review this site and this Policy periodically and to be aware of any modifications. Your continued use of the Website and/or our Services after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by the modified Policy.

Children Under the Age of 16

We direct our Services to a general audience and do not direct any of our content at children under 16 years of age. Our Website is not intended for children under 16 years of age. No one under age 16 shall provide any personal information to us through the Website or through any of its features, register on the Website, make any purchases through the Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 16, we will delete that information. A child’s parent or guardian may request that the personal information of their child be deleted from our records by contacting us at support@z2comics.com.

 

Information Collection and Use Practices

Information Collected Directly from You.

We collect personal information and other data from you when you submit it to us or a third party acting on our behalf. The information collected directly from you depends upon how you use the Services. For example:

Registration Information: When you create an account, we collect your e-mail address, username and password. If you provide it to us, we may also collect additional information from you, including your name, birthday, physical address, zip code/post code, phone number, gender and/or user image.
Purchase Information: If you make a purchase on our Website, we will collect your order-related information, including your billing and shipping address. We will also ask that you provide your payment information (credit card, debit card, or other payment method) at the point of purchase, but we do not directly collect that information. Instead, that information is passed on to our payment processors, or if you use any third party payment services, directly to them.  Purchase Information may also be used in returns or exchanges.
Marketing Information: If you join our marketing e-mail list, we will collect your e-mail address, and when we send marketing e-mails to you, we (or our vendors working on our behalf) will collect information such as your reaction to our marketing, whether you open or share our e-mails, how long you engage with them, and whether you click the links in the e-mails.
Z2 Interaction Information:  When you contact our customer service agents by e-mail, chat, phone, Social Media or via contact forms we provide for that purpose, we will collect (and you expressly consent to our doing so) any personal details and other content that you provide to us, which may include, without limitation, your name, e-mail address, postal address, IP address, geolocation data, and if you contact us via Social Media, your social media handle, your profile photo and any other publicly available information.  We may maintain copies of your customer service correspondences . If you request us to perform additional services on your behalf or submit requests to exercise any of your consumer rights under any applicable law we may collect and maintain your personal information for those purposes as well.  We my collect your search queries on the Website.  We may collect your information in responses to surveys.  If you report any issues regarding the Website we may also collect information from you.
Promotions: If you participate in a Prize Promotion, we may collect and process your name, social media handle, address, e-mail address, phone number, image, photograph, voice, statements, and/or other information, such as the prize you have won.
Information About Others:  You may give us information about other people, such as the name and address of a gift recipient.

You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Website, or transmitted to other users of the Website or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages/you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

You can change your contact data and preferences at any time by contacting us using the contact information at the end of this Policy.  The legal bases for our processing of this data are: your consent, the performance of contractual obligations, our legitimate interests in performing payments for your purchase(s), communicating with customers, advertising our Services, creating an online presence and improving the Services we offer. We retain this information for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. Retention periods are determined based on the nature of the information, the purposes for which it is processed, applicable legal or regulatory requirements, and the need to resolve disputes or enforce agreements. Information from Other Sources.

We may receive information about you from other sources, including third parties that help us update, expand, and analyze our records and identify new customers, and provide products and services that may be of interest to you. We may receive information about you from third parties, including, without limitation, from your friends or family members who invite you purchase gifts for you, third party services and organizations, and other vendor(s) and business partners, such as our data, marketing, personalization, performance, deep linking, or analytics service providers, advertising networks we work with, credit bureaus, fraud prevention service providers, mailing list providers, fulfillment partners, shipping carriers, and/or financial institutions. For example, if you access our Services through a third-party application, such as a social networking site, we may collect information about you from that third-party application that you have made public via your privacy settings. Information we collect through these services may include your name, your user identification number, your user name, location, gender, birth date, email, profile picture, and your contacts stored in that service. Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website.  Third-party Automated Collection

Some content or applications, including advertisements, on the Website are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

Our Services also include Social Media Features, such as the Facebook "Like" or "Share" button and widgets ("Features"). These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. The information we receive is dependent upon your privacy settings with the third party social media service. Features are either hosted by a third party or hosted directly on our site. We do not control these third parties’ tracking technologies or how they may be used.  Our Privacy Policy does not cover these third party companies and we do not accept any responsibility or liability for their policies. Please contact these third party companies (e.g., Google) directly for more information about their privacy policies and your choices regarding the tags and the information collected by the tags.

Do Not Track

Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, we do not respond to browser “do not track” signals.

How We Use Your Information

We use traffic data to analyze traffic for the Services, but we do not examine this information for your identifying information.  Furthermore, we may use IP addresses to help diagnose problems with our server, to administer the Services, or to display contact according to your preferences.  

We may use cookies and other tracking technologies to deliver content specific to your interests and to save your password so you do not have to re-enter it each time you utilize the Services.  We may also use cookies to protect our website and other web-based Services against information technology attacks.  Promotions or advertisements displayed in connection with the Services may contain cookies.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual or otherwise does not constitute personal information as defined by applicable law, without restriction as permitted by applicable law. 

Z2 does not exchange your personal information for monetary consideration.  We may combine or share information among past, current and future Z2 companies, including affiliates and subsidiaries.  We may disclose personal information that we collect or you provide as described in this privacy policy:

To contractors, service providers, and other third parties we use to support our business and marketing. 
Joint venture or marketing partners who may want to send you information about their products or services, unless you have specifically requested that we not share your information for this purpose.
To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Z2's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Z2 about our Website users is among the assets transferred.

Promotional Offers from Z2. If you do not wish to receive promotional e-mails from us, email us at support@z2comics.com to opt-out. You also have the ability to unsubscribe from promotional e-mails via the unsubscribe link included in each promotional e-mail. This opt-out does not apply to operational emails (e.g., surveys).
Access and Edit Personal Information. You may update your personal information anytime
Deletion. You may ask to have your information deleted or removed; however, because we keep track of past transactions, you cannot delete information associated with past transactions on this Website. In addition, it may be impossible to completely delete your information without some residual information because of backups.

 

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

 Your California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. To learn more about your California privacy rights, see document below. 

If you are a California resident and have an established business relationship with us, you can request a notice disclosing the categories of personal information we have shared with third parties, for the third parties’ direct marketing purposes, during the preceding calendar year. To request a notice, please submit your request to support@z2comics.com. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the contact information specified in this section.

Residents of other U.S. States

Residents of Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia have certain rights regarding their personal information. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reason for the decision, within the timeframe required by law.  If your appeal is denied, you may have the right to submit a complaint to the Attorney General’s office of your state.

GDPR and DPA 2018 Compliance.

This Section applies to individuals who are located in the European Union and the United Kingdom. Your use of our website or Services may involve the processing of “personal data” of which the Company is the “controller,” as such terms are defined in Regulation (EU) 2016/679 (the General Data Protection Regulation) (“GDPR”) and, for individuals in the United Kingdom, the GDPR as incorporated into United Kingdom law (“UK GDPR”), together with the United Kingdom’s Data Protection Act 2018 (“DPA 2018”).

International Transfer of Data.  

We are based in the United States of America. The information we collect is processed at Company’s operating offices in the United States of America and in other locations where the parties involved in the processing are located.  If you are accessing the Services from outside the U.S., please be aware that information collected through the Services may be transferred to, processed, stored and used in the U.S. and other jurisdictions.  Data protection laws in the U.S. and other jurisdictions may be different from your country of residence.  Your use of the Services or provision of any information therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of information about you in the U.S. and other jurisdictions as set out in this Privacy Policy.  If your data is collected outside of the United States of America, we will transfer your personal data subject to appropriate safeguards, such as European Standard Contractual Clauses.    

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. This Privacy Policy for California Residents (the “CA Policy”) supplements the information contained in Z2's Privacy Policy above and applies solely to all visitors, users, and others who reside in the State of California ("consumers" or "you").

The California Consumer Privacy Act of 2018 (“CCPA”), as amended and supplemented by the California Privacy Rights Act of 2020 (“CPRA”), provides additional rights to know, delete and opt out, and requires businesses collecting or disclosing personal information and sensitive personal information to provide notices and means to exercise certain rights.  Unless otherwise specified herein, to exercise any of these rights, please submit a request to us using the contact details at the end of this Privacy Policy.  In the request, please specify which right you are seeking to exercise and the scope of the request. We will confirm receipt of your request within ten (10) days.  We may require specific information from you to help us verify your identity and process your request.  

This notice, and the rights described, currently do not apply to job applicants, current or former employees, contractors, or persons interacting with us in their capacity as a representative of a business.

Your Rights and Choices 

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Right to Know and Data Portability

You may have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the "right to know"). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will disclose to you:

The categories of personal information we collected about you.
The categories of sources for the personal information we collected about you.
Our business or commercial purpose for collecting or selling that personal information.
The categories of third parties with whom we share that personal information.
If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
o sales, identifying the personal information categories that each category of recipient purchased; and 
o disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained. 
The specific pieces of personal information we collected about you (also called a data portability request).

Right to Delete 

You may have the right to request that we delete certain of your personal.  Exceptions apply. Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will review your request to see if an exception allowing us to retain the information applies. 

Right to Limit Use and Disclosure of “Sensitive Personal Information”

Notwithstanding anything herein to the contrary, you have the right, at any time, to request that we limit our use and disclosure of your “sensitive personal information”, as that phrase is defined in the CPRA, to those uses and disclosures that are necessary for us to: (i) perform the Services, as reasonably expected by an average consumer who requests the Services; and (ii) engage in the activities expressly set forth in CPRA and related regulations. To make such a request, please contact us using the contact information at the end of this Privacy Policy.

Right to Correct

You have the right to request that we correct any inaccurate personal information about you.  

Right to Non-Discrimination

You have the right not to receive discriminatory treatment by us for the exercise of any of your rights.

Exercising Your Rights

To exercise your rights to know or delete described above, please submit a request by either:

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. To designate an authorized agent, you must provide the agent, and the agent must present to us, written permission signed by you.  We may also require you to verify your identify directly with us and directly confirm with us that you provided the authorized agent permission to submit the request, unless your authorized agent provides us with power of attorney pursuant to Probate Code sections 4121-4130.  

You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:
o If you have an account with us, we may verify your identity by requiring you to sign in to your account. However, you do not need to create an account with us to submit a request to know or delete.  If you request access to or deletion of your personal information and do not sign in to an account with us, we require you to provide the following information: name, email address, phone number, and postal address. In addition, if you do not have an account and you ask us to provide you with specific pieces of personal information, we reserve the option to require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Personal Information Sales Opt-Out and Opt-In Rights

If you are age 16 or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we actually know are less than 16 years old, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 15 years old, or the parent or guardian of a consumer less than 13 years old. Consumers who opt-in to personal information sales may opt-out of future sales at any time. 

To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by emailing us at support@z2comics.com

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by emailing us at support@z2comics.com

 

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request. 

Non-Discrimination

We will not discriminate against you in a manner prohibited by the CCPA because you exercise your CCPA rights. However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. We currently are not providing any financial incentive programs.
